How to File a Claim to Uber about a Driver

In order to file a claim to Uber about the actions of a Driver you should contact them through the app. Reporting an accident or incident to Uber is not required to maintain a claim against Uber. However, your report could help prevent the Uber Driver from having future access to the Uber Driver Application.

If you are injured in an accident or have been the victim of sexual assault in an Uber, you should report the incident to the rideshare company through their app or website.

As a Rider

You may inform Uber of a complaint through the app or through the Uber website. On the app, select your account by clicking on the small image in the bottom, right-hand corner. Then, select the help button near the top left. Select “Help with a trip” and then “Report safety incident.” Finally, you will be given a list of potential safety incidents to choose from. Uber will then request you to provide the important details.

To report an incident on the Uber website, login to your account. Then use the I was involved in an accident form to report the accident. You’ll choose the trip where the accident occurred from your list of trips.

As a third-party

To report an incident with Uber as a third party, like another driver that is involved in an accident with Uber, complete the third party incident notice. The information you will need to provide includes:

  • Name
  • Email address
  • Phone number
  • Who you are as a requester (as a private individual, you are an “other.” The other options are insurance carrier and attorney).
  • What you are doing – the options are reporting an accident, verifying a driver or following up on an existing claim.
  • Accident details
  • Whether an insurance claim has already been made
  • Date of the incident
  • Where the accident occurred
  • If there were injuries or fatalities
  • Riders in the vehicle, if known
  • Whether a police report was filed
  • Information for any third parties involved

The more information you can provide, the better. If you know the driver’s name, phone number, email, drivers license number and vehicle details, report them. Of course, you may not know all the details. That’s okay. Do your best to get this information at the time of the accident or from the police report. However, make your report even if you don’t have every piece of information Uber requests.

There is a place for you to upload photos, videos and documents.

Reporting Sexual Misconduct or Sexual Assault to Uber

To report driver sexual misconduct or sexual assault to Uber:

  • Navigate in the app to “Account”
  • Navigate to “Help”
  • Select “Help with a trip”
  • Choose the trip where the assault or sexual assault occurred.
  • Scroll down and select “report safety issue.”
  • Choose “Report a safety incident involving a driver” or “Report a Safety Incident Involving a Co-rider.”
  • Provide the relevant details

You may report an assault or sexual assault involving an Uber driver, another passenger or a third party in relation to an Uber ride. Assault and sexual assault are serious crimes. Report the incident to law enforcement in addition to making a report to Uber. Law enforcement may proceed with an investigation and criminal charges regardless of how Uber responds. In addition, Uber may take action even if law enforcement does not authorize criminal charges.

Remember, Uber profits when people use their rideshare service. Even though sexual assault is a massive problem for riders and drivers, the rideshare company may try to minimize incidents of sexual assault. It may be appropriate to file a lawsuit against Uber because they failed to do enough to protect you from sexual assault.

Hundreds of women have already filed. A victim of any gender may file. As a lawyer handling Uber assault and sexual assault claims, Bret Stanley is working to make these claims easier for sexual assault victims, leading in litigation to represent assault and sexual assault claims involving Uber rideshare services. Lawsuits may be based on Uber failing to file proper background checks and allowing unsafe drivers to remain active in the app.
